Petitioner is languishing in judicial custody since 13.04.2016 in connection with Navinagar P.S. Case No. 51/16 registered for the offences punishable under Sections 25(1b)a/26/35 of the Arms Act. The prosecution case, as lodged by the police, is that petitioner and one another were apprehended and from the possession of the petitioner one country-made pistol and two live cartridges and from the possession of one Sheo Ranjan Kumar Singh one country-made pistol and one live cartridge was recovered.
It has been submitted by the learned counsel for the
Patna High Court Cr.Misc. No.53350 of 2016 (2) dt.22-12-2016 petitioner that he is innocent, has no criminal history, charge-sheet has already been submitted and on similar allegation another coaccused has since been granted the privilege of bail in Cr. Misc. No. 34523 of 2016 on 20.08.2016.
However, learned A.P.P. for the State submits that the petitioner is named in the First Information Report, hence, opposes the prayer for bail.
Be that as it may, considering the facts and circumstances and submission of the parties and that charge sheet has already been submitted and another co-accused on similar allegation has since been granted the privilege of bail, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Addl. Chief Judicial Magistrate, Aurangabad in connection with Navi Nagar P.S. Case No. 51/16.
