JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-07-2019 Petitioner seeks bail in anticipation of his arrest in connection with Kesariya P.S. Case No. 173 of 2016, G.R.No. 3207 of 2016, registered for the offences punishable under Sections 406, 420, 468, 120B and 506 of the Indian Penal Code. Allegation as per complaint petition, in short, is that petitioner and other accused persons on the pretext for providing job in foreign country has taken 1.25 lac from the son of the informant/complainant and also taken money from other witnesses but they failed to provide job and did not return the money.

Submission of learned counsel for the petitioner is that as a matter of fact he has taken Rs. 1.25 lac from the son of the informant/complainant and further he has taken Rs.50,000/- from others and he has provided Visa but they could not go to

In view of above facts and circumstances, petitioner is directed to surrender by 8.8.2019 along with a Bank Draft of Rs.1.25 lac in favour of the son of informant/complainant and on deposit of the same, he will be released on provisional bail for a period of one month and during that period he will deposit Rs.50,000/- by way of Bank Draft in favour of son of complainant/informant and once the total amount is deposited, his bail bonds shall be confirmed that the aforesaid payment will be subject to the result of the case. It is made clear that if an application is filed on behalf of the complainant/informant and the witnesses, the amount shall be released in their favour. With the above observation, this application is disposed of.
