JUSTICE BIRENDRA KUMAR ORAL ORDER 20-12-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Sections 147/148/149/307 of the Indian Penal Code and Section 27 of the Arms Act.
For land dispute both sides allegedly fired against each other. The firing resorted by the petitioner caused injury to Jairam Kumar on his stomach.
Submission of the petitioner is that the doctor has found laceration at the abdomen of Jairam Kumar and the petitioner is in custody since 06.08.2016. Moreover, the petitioner had lodged Kako P.S. Case No.175 of 2015 alleging therein that petitioner sustained fire-arm injury at his face and other vital part
Patna High Court Cr.Misc. No.42289 of 2016 (4) dt.20-12-2016 2/2 of the body at the instance of the named accused persons including the informant of this case. Injury report of the petitioner is also enclosed with the bail petition.
Learned counsel for the informant opposed the prayer for bail on the ground of seriousness of the allegation against the petitioner.
Considering the fact that it is not in dispute that the petitioner also sustained fire-arm injury in the occurrence, which has taken place due land dispute between the parties, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of Mr. R. Kumar Rajak, learned Sub Judge-IV, Jehanabad/Successor Court, in connection with Kako P.S. Case No.176 of 2015.
