Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks regular bail in connection with Bihta (Neura) P.S. Case No. 683 of 2020 lodged under Sections 8, 20(ii)(C), 25 and 29 of the N.D.P.S. Act.

As per prosecution, total 2570.400 kg. of ganja were recovered in this case.

Learned counsel for the petitioner submits that antecedent of the petitioner is clean and he is in custody since 14.09.2020. Vide order dated 20.04.2022 this case has been put on alongwith Cr. Misc. No. 43587 of 2021 arising from same

Patna High Court CR. MISC. No.50093 of 2021(6) dt.28-09-2022 2/2 Bihata P.S. Case No.683 of 2020.

Learned counsel for the State opposes the prayer for bail and submits that the present petitioner is co-driver of the truck on which the alleged ganja has recovered. Considering the quantity of recovery which is more than the commercial quantity of NDPS substance, I am not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is hereby rejected. The Trial Court is directed to conclude the trial expeditiously.

The Superintendent of Police, Patna is directed to take all the steps to produce the prosecution witnesses on each and every date fixed by the Court.

Office is directed to communicate the said order along with order dated 07.04.2022 passed in Cr. Misc. No. 43587 of 2021 to the Superintendent of Police, Patna for perusal and necessary action.

With this observation, the bail application stands rejected.
