The petitioner apprehends his arrest in Kursakanta P.S. Case No.62 of 2021 registered under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case merely on the basis of confessional statement of co-accused. It is further submitted that nothing has been recovered from possession of the petitioner. He also submits that the petitioner has no concern with the seized vehicles.

The petitioner has got no criminal antecedent.

Having considered the above facts and circumstances of the case, the petitioner, above named, in the event of his

No.49875 of 2021(5) dt.09-05-2022 2/2 arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing personal bond to the satisfaction of learned 2nd Additional Sessions Judge-cum-Special Judge, Araria in connection with Kursakanta P.S.

Case No.62 of corresponding to Special Excise Case No.334 of 2021, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
