JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 24-07-2015 At the outset, it is pointed out that petitioner No. 1 namely, Vijay Yadav @ Birendra Kumar has already been arrested.

Accordingly, his prayer for anticipatory bail in connection with Kashichak P.S. Case No. 89 of 2014 stands dismissed being infructuous.

Heard learned counsel for petitioner No. 2 namely, Gariban Yadav and learned Additional Public Prosecutor for the State.

Petitioner apprehends his arrest in connection with Kashichak P.S. Case No. 89 of 2014 registered under Sections-307, 379 & other minor sections of the Indian

Patna High Court Cr.Misc. No.28012 of 2015 (2) dt.24-07-2015 2/2 Penal Code.

Petitioner No. 2 is named in the first information report but only omnibus allegation has been levelled against the petitioner. The injury report of informant reveals that he sustained only one injury, said to be caused by hard and blunt substance and simple in nature.

Considering the aforesaid facts and circumstances as well as submission of the parties, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, let the petitioner No. 2. namely, Gariban Yadav be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kashichak P.S. Case No. 89 of 2014 to the satisfaction of Chief Judicial Magistrate, Nawada subject to conditions as laid down u/S 438(2) of the Cr. P.C. (Hemant Kumar Srivastava, J) A.K.V./- U T
