JUSTICE BIRENDRA KUMAR ORAL ORDER 18-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 498A/34 of the Indian Penal Code and Section 4 of the Dowry Prohibition Act.

Petitioner is the husband of opposite party no.2. Allegation is of demand of dowry and torture for the same. The impugned order reveals that the prayer for bail was refused because the petitioner had refused for restoration of conjugal life. Petitioner is in custody since 06.12.2016.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.9266 of 2017 (3) dt.18-04-2017 let petitioner, above named, be enlarged on bail on completion of six months of custody on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Katihar/Successor Court, in connection with Complaint Case No.1732 of 2013, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
