25-11-2021 Heard learned counsel for the parties.

The petitioner seeks bail in Sakra P.S. Case No. 294 of 2021, registered for the offence under Sections 147, 272, 273, 353, 467, 468, 469 & 471 of the Indian Penal Code and Sections 30(a), 36, 47 of the Bihar Prohibition and Excise Act. As per the prosecution case, co-accused Ravindra Paswan was apprehended with illicit liquor and while he was being taken away by the police, this petitioner alongwith other FIR named accused created nuisance and pelted stones on the police party.

It is submitted on behalf of petitioner that petitioner has been made accused only on the basis of confessional statement of co-accused Ravindra Paswan, who was apprehended by the police. No incriminating article has been recovered from the conscious possession of the petitioner. There

Patna High Court CR. MISC. No.50026 of 2021(2) dt.25-11-2021 2/2 is general and omnibus allegation and no specific overt act has been alleged against this petitioner. Petitioner has got clean antecedent and he is in custody since 03.06.2021. Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Muzaffarpur in connection with Sakra P.S. Case No. 294 of 2021.
