JUSTICE MOHIT KUMAR SHAH ORAL ORDER 08-09-2021 The instant case has been taken up for consideration through the mode of Video conferencing in view of the prevailing situation on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioners and Sri Shyam Kr. Singh, the learned APP for the State.

Patna High Court CR. MISC. No.50875 of 2021(2) dt.08-09-2021 2/3 The present petition has been filed for correcting the typographical error in the Order dated 14.07.2021, passed in Cr. Misc. no. 9990 of 2021,to the extent that the P.S. case number has wrongly been stated as Jadopur PS case no. 124 of 2019, instead of Gopalpur PS case no. 124 of 2019.

The learned counsel for the petitioners has submitted that the petitioners were granted anticipatory bail by an order dated 19.06.2020, passed in Cr. Misc. no. 8303 of 2020, however the petitioners could not surrender within the stipulated time frame in order to avail the privilege of anticipatory bail, hence they had approached this Court for modification of the said order dated 19.06.2020 by filing a petition bearing Cr. Misc. no. 9990 of 2021 which was disposed of by this Court by an Order dated 14.07.2021 granting further four weeks' time to the petitioners to surrender before the learned court of Judicial Magistrate 1st class, Gopalganj in order to avail the privilege of bail, however on account of mistake in the modification petition itself, the P.S. case number was wrongly depicted in the said order dated 14.07.2021 as Jadopur PS case no. 124 of 2019 instead of Gopalpur PS case no. 124 of 2019, hence it is prayed that the same be corrected, inasmuch as the petitioners have already surrendered before the Ld. court below and have been

Patna High Court CR. MISC. No.50875 of 2021(2) dt.08-09-2021 3/3 granted bail.

The learned APP for the State Sri Shyam Kr. Singh has got no objection.

Having regard to the facts and circumstances of the case, the order dated 14.07.2021, passed in Cr. Misc. no. 9990 of 2021 stands corrected to the extent that the case number depicted in the second last paragraph of the said order as Jadopur PS case no. 124 of 2019 be read as Gopalpur PS case no. 124 of 2019.

The present petition stands disposed of with the aforesaid modification in the order dated 14.07.2021, passed in Cr. Misc. no. 9990 of 2021.
