JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-12-2016 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The application is for grant of bail for the offence under Sections 30 (A)/41/A of the Excise (Amendment) Act, 2016. It has been submitted on behalf of the petitioner that 55 bottles of foreign-made liquor was recovered from the motorcycle of the petitioner. The petitioner has clean antecedent and he is in custody for more than two months.

Heard learned A.P.P.also.

From perusal of the record, it appears that the petitioner is in custody for more than two months and he has no criminal antecedent. Further the seizure list also shows that there is no compliance of Section 100 Criminal Procedure Code.
