The petitioners seek bail in connection with Majorganj P.S. Case No. 159 of 2016, registered for the offence punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Allegation is that three unknown miscreants came by a motorcycle and sprayed bullet resulting the death of deceased on place of occurrence.

Learned counsel for the petitioners submits that they have not been named in the F.I.R. Only allegation that has come against the petitioners is that their nephew Deena Pandey is active member of an extremist organization to whom the petitioners used to provide him shelter. The other co-accused Sudhir Kumar Singh

Patna High Court Cr.Misc. No.5958 of 2017 (2) dt.22-02-2017 2/2 and Prem Ranjan Singh, having similar allegation have already been extended the privilege of bail vide Cr. Misc. No. 51010 of 2016 on 22.12.2016 and Cr. Misc. No. 49360 of 2016, on 10.01.2017 respectively.

Considering the nature of the allegation against the petitioners and the fact that the similarly situated co-accused persons are enjoying privilege of bail, their prayer of bail is allowed. The petitioners, above named, are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate 1st Sitamarhi in connection with Majorganj P.S. Case No. 159 of 2016.
