The petitioners have filed the instant application for grant of regular bail in connection with Kaler P.S. Case No.3 of 2020 registered under sections 302, 201 and 34 of the Indian Penal Code.
As per the allegation in the F.I.R., it is stated by the informant that his Samdhi informed him about his daughter having been burnt and they were going to hospital for treatment. He further states that he married his daughter with the son of the petitioner no.1.
It is submitted by learned counsel for the petitioners that they are the father-in-law and brother-in-law of the
Patna High Court CR. MISC. No.5254 of 2021(4) dt.27-07-2021 2/2 deceased. The husband of the deceased has not been made accused. The petitioners are living separately. The daughter of the informant got burnt while cooking food. The petitioners have no criminal antecedent and are in custody since 9.6.2020. The investigation of the case has concluded.
The application for bail is opposed by learned A.P.P. for the State.
Having heard learned counsel for the parties and taking into consideration the relationship of the petitioners with the deceased together with they having remained in custody for over 1 year, the Court is inclined to enlarge the petitioners on bail. The petitioners are directed to be enlarged on bail in connection with Kaler P.S. Case no.3 of 2020 on each of them furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Arwal.
