The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 307, 427, 379, 436, 337, 353, 504 of the Indian Penal Code.

The prosecution case in short is that after death of a patient in course of treatment, 150 persons assembled in the hospital and created chaos and the government hospital was ransacked. It has been submitted on behalf of the petitioner that the petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 25-03-2019. Charge sheet has already been submitted. General and omnibus allegation has

Patna High Court CR. MISC. No.36776 of 2019(2) dt.24-06-2019 2/2 been made against the petitioner. The petitioner is not named in the FIR. The name of the petitioner has surfaced in this case on the basis of confessional statement of co-accused. The other coaccused with similar allegation have been granted bail by coordinate bench of this court vide order dated 20-05-2019 passed in Cr. Misc. No. 32878 of 2019.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VII, Buxar in connection with Rajpur P.S. Case No. 62 of 2019.
