Petitioner is languishing in custody since 05.09.2016 in connection with Barhara P.S. Case No. 264 of 2016 for the offences punishable under Sections 324/326/307/302/504 and other minor sections of the Indian Penal Code and Section 27 of the Arms Act.

The allegation of commission of assault with lathi is against 22 accused persons including the petitioner. Specific allegation of commission of fire-arm injury to Rakesh is against co-accused Hira Lal Ray and allegation of commission of fire-arm injury to Umesh Yadav is against Rajesh Ray. Rakesh Kumar Yadav succumbed to injury and Umesh Yadav was rushed to the hospital.

Patna High Court Cr.Misc. No.52697 of 2016 (2) dt.07-12-2016 2/2 Submission is that the doctor has found single fire-arm injury on the person of the deceased, which is not attributed against the petitioner.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur (Ara) in connection with Barhara P.S. Case No.264 of 2016.
