JUSTICE BIRENDRA KUMAR ORAL ORDER 22-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State. Petitioner is languishing in custody for the offences punishable under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

The F.I.R. named accused persons called the deceased from his house and in the morning the dead body was found.

Submission is that petitioner is not named in the F.I.R. Name of the petitioner has transpired in the confessional statement of co-accused.

Considering the facts and circumstances, let petitioner, above named, be enlarged on bail on furnishing bail

Patna High Court Cr.Misc. No.13338 of 2017 (2) dt.22-03-2017 2/2 bond of Rs.10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Danapur, Patna/Successor Court, in connection with Naubatpur P.S. Case No.266 of 2016, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court-below shall be at liberty to take steps for cancellation of the bail-bonds of the petitioner in this case.
