The petitioner seeks bail in connection with Garkha P.S. Case No.250 of 2016 registered under Sections 413 and 414/34 of the Indian Penal Code.
The accusation is that on seeing the police party, two persons, who were on motorcycle, started to flee away, leaving the motorcycle, but they were apprehended, on chase, by the police, who disclosed their name as Rajesh Kumar (petitioner) and Ravindra Singh. On query, they could not produce any paper regarding the ownership of the motorcycle and confessed that they used to commit the theft of the motorcycle by forming a gang and
Patna High Court Cr.Misc. No.2167 of 2017 (4) dt.22-03-2017 2/2 also disclosed the name of their associates.
Learned counsel appearing on behalf of the petitioner submits that the petitioner has falsely been implicated in this case on mere suspicion and the petitioner having no criminal antecedent is in custody since 14.08.2016.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-V, Saran at Chapra, in connection with Garkha P.S. Case No.250 of 2016. Out of the two sureties, one must be close relative of the petitioner, who will file an affidavit giving genealogy as to how he/she is related with the petitioner. The bailors will undertake to furnish information to the court about any change in the address of the petitioner. (Rajendra Kumar Mishra, J) P.S./- U T
