JUSTICE SUDHIR SINGH ORAL ORDER 20-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in a case instituted under Sections 341, 323, 324, 307 and 504/34 of the Indian Penal Code.
As per prosecution the main accusation against the petitioner is of assaulting to the informant, his wife, his son and daughter and his mother by using bricks.
It has been submitted on behalf of the petitioner that it is a case and counter case. It is further submitted that counter case is Annexure 2 to the present case. It has also been submitted that due to land dispute between the parties, the petitioner has falsely been implicated in the present case. It is also pointed out that the injuries sustained by the accused side have not been explained by
Patna High Court Cr.Misc. No.26274 of 2015 (2) dt.20-07-2015 2/2 the prosecution.
On behalf of the State it has been submitted that the petitioner is named in the FIR.
Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.,Siwan in connection with Barharia P.S.Case No. 76 of 2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
