The petitioner seeks bail in Case No.

03C2/2017 instituted for the offence under Sections 37(a), 32(i), 38(i) and 56(d) of the Bihar Excise (Amendment) Act. It is alleged that three persons moving on the motorcycle tried to run away on seeing the police party but one person was apprehended who disclosed his name as Fantus Yadav, the petitioner. From the possession of the petitioner total ten bottles of foreign liquor each containing 750 ml and 45 pieces of country made liquor were recovered.

It has been submitted that petitioner is in custody since 12.01.2017.

In the facts and circumstances of the case, the prayer of the petitioner for regular bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Lakhisarai in connection with Case No. 03C2/2017, subject to the condition that both the bailors shall be the close relative of the petitioner.
