JUSTICE SANJAY KUMAR ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner seeks bail in connection with Bhorey Police Station Case No. 152 of 2017 registered for offences punishable under sections 394, 307 of the Indian Penal Code and section 27 of the Arms Act.

The case has been registered against the unknown miscreants. It has been submitted that the petitioner is not named in the FIR. He was apprehended merely on suspicion. The Police allegedly recorded his confession wherein he confessed his complicity and except his confession, there is nothing against him. The similarly situated co-accuseds, namely, Damodar Singh, Ramu Kushwaha and Suraj Choubey have been allowed bail by

Patna High Court Cr.Misc. No.30192 of 2018 (3) dt.03-07-2018 2/2 different coordinate Benches of this Court in Cr. Misc. No. 28957 of 2017 and Cr. Misc. Nos. 24269 and 24378 of 2018. The case of the petitioner stands on similar footing.

Considering the facts and circumstances of the case, the prayer for bail of the petitioner is allowed and he is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XII, Gopalganj in connection with Bhorey Police Station Case No. 152 of 2017, subject to the following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.

(ii) The petitioner will not induce any witness or tamper with the evidence.

(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
