The petitioner prays for grant of regular bail in a case registered for the offence punishable under sections 302,120B/34 of the Indian Penal Code.
Petitioner and other accused persons named in the FIR have been suspected to have killed cousin brother of the informant as they had dispute with regard to money transaction.
Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion. No incriminating material has been recovered from the conscious possession of the petitioner. The accused persons and the deceased were doing contract activities together and there was some dispute with regard to money transaction. Petitioner's name has figured during course of investigation in his confessional statement and no other substantive evidence has been collected during course of
Patna High Court CR. MISC. No.49497 of 2021(3) dt.20-01-2022 2/2 investigation to suggest the implication of this petitioner in the present case. Petitioner has claimed clean antecedent and he is in custody since 12.2.2021.
Learned counsel appearing for the State opposes the prayer for bail.
Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in Kursela Police Station Case No. 25 of 2021.
