JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 06-12-2022 At the outset, learned counsel of the petitioner seeks permission to make correction in the title name of petitioner Nos.1, 2 and 5. It is submitted that petitioner No.1 may be read as Sk. Latif @ Sk. Khalil, petitioner No. 2 may be read as Jadu Khatoon @ Saminar Khatoon @ Samina Khatoon and petitioner No. 5 may be read as Bano Begum @ Sahar Bano. Permission accorded.

Heard learned counsel for the petitioners and the

Patna High Court CR. MISC. No.44431 of 2022(2) dt.06-12-2022 2/3 State.

Petitioners apprehend arrest in a case registered for the offence punishable under Sections 323, 379, 307/34 and other allied sections of Indian Penal Code.

As per prosecution case, petitioners along with other FIR named accused persons assaulted informant and family members by means of iron rod.

Learned counsel appearing for the petitioners submits that petitioners are innocent and have falsely been implicated in this case. Specific accusation of assault on the head of the informant by means of iron rod is against co-accused Sk. Kalu. So far these petitioners are concerned there is general and omnibus allegation. Case and counter case. Both sides sustained injury. Petitioners have got clean antecedent. Considering the aforesaid facts and circumstances, let the above named petitioners in the event of their arrest/surrender before the court below within a period of thirty days from the date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Katihar in Manihari P. S. Case No. 84 of 2022, subject to condition as laid down under Section 438(2)
