JUSTICE BIRENDRA KUMAR ORAL ORDER 09-03-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is apprehending his arrest in a case registered for the offence punishable under Section 387 of the Indian Penal Code.

From the referred mobile number a call for demand of ransom was received by the informant. The FIR was lodged against unknown.

Learned Additional Public Prosecutor, after perusal of the case diary, submits that up-till-now it has not been brought to light as to in whose name the refereed mobile stands. The petitioner has stated on oath that he has got no criminal antecedent.

Considering the aforesaid facts, let the petitioner,

Patna High Court Cr.Misc. No.55546 of 2016 (4) dt.09-03-2017 2/2 above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran, Motihari/successor Court in connection with Muffasil Police Station Case No. 212 of 2015, G.R. No. 3737/15, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
