JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-06-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The order of the court below reflects that due to hindrance made by the petitioner, the trial could not be concluded. However, learned counsel for the petitioner submits that a petition under section 311 of the Cr.PC was filed before the court below and the aforesaid petition was dismissed by the court below and, thereafter, the petitioner has filed petition for quashing the aforesaid order before this Court and the same is pending before this Court. He further submits that the defence of the petitioner was closed by the court below without giving proper opportunity to the petitioner and that was the reason, petitioner

Patna High Court Cr.Misc. No.14638 of 2017 (2) dt.21-06-2017 2/2 filed a petition under section 311 of the Cr.PC. Considering the aforesaid submission as well as facts and circumstances of the case, again, I am not inclined to release the petitioner on bail and, hence, his prayer for bail in connection with Sessions Trial No. 288 if 2016 arising out of Jehanabad P.S. Case No. 568 of 2015 pending in the court of 2nd Additional Sessions Judge, Jehanabad stands rejected.
