JUSTICE SUDHIR SINGH ORAL ORDER 07-05-2015 The petitioners are apprehending their arrest in connection with Sadar P.S.Case No. 117/2014 instituted under Sections 147, 341, 328, 225, 379, 376, 511 and 504 xxx of the Indian Penal Code.

Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that while the informant was sleeping, accused Ranjit Ram attempted to commit rape upon her. Informant raised alarm on which petitioners came there and rescued Ranjit Ram from the custody of the informant. It is also alleged that the accused persons including the petitioners further abused, assaulted and undressed the informant

Patna High Court Cr.Misc. No.52028 of 2014 (3) dt.07-05-2015 2/2 and petitioner Jagdish Ram snatched away of silver locket from the neck of the informant.

It has been submitted on behalf of the petitioners that prior to the institution of the present case co-accused of this case Ranjit Ram had instituted a case i.e.Sadar P.S.Case No. 116 of 2014 against the informant side and others. The present case is only an outburst of the case, which was instituted against the informant's husband. Further it has been submitted that no specific allegation has been made against the petitioners. On behalf of the State, it has been submitted that the petitioners are named in the FIR.

Considering the aforesaid facts, let the above named petitioners, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M., Darbhanga, in connection with Sadar P.S.Case No. 117/2014 , subject to the conditions as laid down u/s 438(2) Cr.P.C.
