JUSTICE MOHIT KUMAR SHAH ORAL ORDER 28-05-2018 Heard the learned counsel for the petitioner and the learned APP for the State.
The petitioner seeks regular bail in connection with Sikroul Town PS case no. 100 of 2017 instituted for the offences punishable under Section 414 of Indian Penal Code and 25(1-b)A, 26, 35 of Arms Act.
The allegation is regarding the petitioner and the other accused persons having been apprehended by the police, whereafter one countrymade pistol and live cartridges were recovered.
The learned counsel for the petitioner submits that as far as the motorcycle is concerned, the same belongs to co-accused person and the petitioner has been falsely implicated in
Patna High Court Cr.Misc. No.26880 of 2018 (3) dt.28-05-2018 2/2 the present case. It is further submitted by the learned counsel for the petitioner that though the petitioner is an accused in six cases, however he has been remanded in most of the cases by the police upon a confession recorded by the police forcibly from the petitioner. It is further submitted that no arm has been recovered from the petitioner and he is languishing in custody since 04.12.2017.
Having regard to the facts and circumstances of the case, the abovenamed petitioner is directed to be released on regular bail immediately upon completion of six months of custody on such conditions as may be imposed by the court of Additional Chief Judicial Magistrate-VIth, Buxar.
