The petitioners are languishing in custody in a case registered for the offences punishable under Sections 304(B), 201, 363 / 34 of the Indian Penal Code.

The accusation is of killing the daughter of the informant for non-fulfillment of dowry demand. It is submitted by learned counsel for the petitioners that petitioners are innocent and they have falsely been implicated in this case. There is general and omnibus allegation against the petitioners. The petitioners are the brother-in-law (Bhaisur) and Gotni of the deceased. The husband of the victim

Patna High Court CR. MISC. No.40890 of 2023(2) dt.14-07-2023 2/2 has not been made as accused. Other similarly co-accused persons i.e. father-in-law, brother-in-law and sister-in-law of the deceased have been granted bail vide order dated 11.05.2023 in Cr. Misc. No. 10040 of 2023 by a Co-ordinate Bench of this Court. The petitioners have no criminal antecedent and are languishing in custody since 16.03.2023. The charge-sheet has already been submitted against the petitioners. Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Lalganj P.S.
