The petitioner seeks regular bail in connection with Gaya Muffasil P.S. Case No.569 of 2025 registered for the offence under sections 65(1) and 3(5) of the B.N.S., 2023 and under sections 4, 6, 10 and 12 of the POCSO Act.

The victim, who is aged about 13 years, has filed a written complaint stating therein that her father and the petitioner, who is the maternal uncle (phupha) of the victim, have sexually assaulted her. It has also been stated that the petitioner has established physical relationship with the victim

The petitioner is in custody since 25.08.2025.

Considering the nature of allegation levelled against the petitioner of having established sexual relationship with a minor girl, I am not inclined to grant bail to the petitioner. Accordingly, this bail application is rejected. 6.

It is, however, clarified that the observations made herein are limited to the adjudication of the present bail application and shall not prejudice the case of the petitioner at any subsequent stage of the trial and this Court has not expressed any opinion on the merits of the case.
