The petitioner, already in custody, seeks bail in connection with Sessions Trial No. 267 of 2017 arising out of Dinara P.S.Case No. 71 of 2017 registered under Sections 304B and 201/34 of the Indian penal Code and 3 and 4 of the Dowry Prohibition Act.
Allegation in brief is that within three years of marriage of the deceased solemnized with the petitioner alleged to have been killed and dead body disposed of discretely as the demand of dowry was not fulfilled.
Learned counsel for the petitioner submits that petitioner's wife died of pain in abdomen.
However, learned counsel for the state submits that there is specific accusation against petitioner's with regard to killing and disposing dead body of his wife on account of non-
Patna High Court Cr.Misc. No.29436 of 2018(4) dt.17-07-2018 2/2 fulfillment of dowry and there is no medical prescription or any document to show that she died of illness.
Having considered the aforesaid facts and circumstances, the Court is not persuaded to grant bail to the petitioner. Accordingly, prayer of bail of the petitioner is rejected. (Arun Kumar, J) sujit/- U T
