JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-02-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under sections 302/34 of the Indian Penal Code.
It is alleged by the informant that this petitioner, Hakdeo Prasad, Devendra Prasad, Naveen Prasad and two-three others were slitting the neck of his father. It is submitted by learned counsel for the petitioner that in the subsequent statement the informant has alleged that the neck was being slit by Suresh and Hakdeo though the family members of the informant suggested that due to darkness no accused could be identified. The postmortem report suggests only one injury.
Patna High Court Cr.Misc. No.3220 of 2014 (12) dt.03-02-2015 2/2 Considering the nature of accusation, this court is not inclined to grant anticipatory bail to the petitioner in connection with Madhuban P.S. Case No. 142 of 2013 pending in the court of the learned C.J.M. East Champaran, Motihari.
This application is, accordingly, dismissed.
