ANJANA MISHRA ORAL ORDER 02-05-2018 Heard learned counsel for the petitioners and the learned counsel appearing on behalf of the State. The petitioners are in custody since 08.02.2018 in connection with Kaji Mohammadpur P.S. Case No.63 of 2018 registered for the offences under Sections 147, 148, 149, 332, 333, 353, 452, 427, 307, 323, 324, 326, 379 and 120B of the Indian Penal Code.
Learned counsel for the petitioners submits that the entire allegation against these petitioners is general and omnibus in nature and at best, they can be treated to be the members of the mob. It is further submitted that many persons
Patna High Court Cr.Misc. No.21238 of 2018 (3) dt.02-05-2018 2/2 had collected at the place of occurrence and protested against the removal of encroachment and, therefore, the names of these petitioners have also been taken on mere suspicion. It is further submitted that similar situated co-accused, namely, Md. Guddu @ Md. Quasim and Shiva Shankar Prasad, have been extended the privilege of bail in Cr.Misc. No.19960 of 2018 vide order dated 26.04.2018 and in Cr.Misc. No.20298 of 2018 vide order dated 16.04.2018 respectively.
In view of the aforementioned facts and circumstances of the case, let the petitioners, above named, be released on bail on their furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, (East) Muzaffarpur, in connection with Kaji Mohammadpur P.S. Case No.63 of 2018.
