The petitioner seeks bail in a case instituted under Sections 363, 364-A, 302, 201 and 120-B/34 of the Indian Penal Code.
The prosecution case, in brief, is that the informant's son had gone to Nawalpur Bazar and when he did not return till 5.00 in the evening, the wife of the informant informed the informant on his cell phone and thereafter they along with family members started searching him at all probable place but he could not be traced.
Earlier the bail application of the petitioner was rejected vide Annexure-1 to the present application.
Patna High Court Cr.Misc. No.20214 of 2017 (3) dt.17-05-2017 2/2 A report was called for from the trial court regarding the stage of the case. It has been reported that charge has been framed on 13.04.2017. The petitioner is in custody since 22.02.2016. He is not named in the F.I.R. His name has come on the confessional statement of co-accused. The other co-accused have been granted bail vide Cr. Misc. No. 26288 of 2016, 28606 of 2016, 37067 of 2016 and 11646 of 2017.
On behalf of the State, it has been submitted that the petitioner is not named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, West Champaran, Bettiah in connection with S. T. No. 507 of 2016, arising out of Jogapatti (Nawalpur) P.S. Case No. 38 of 2016.
