JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 420 and 406 of the Indian Penal Code.

It is alleged that the petitioner and Satyendra Kumar Bhagat took Rs.500/- from the prospective beneficiaries of Indira Awas scheme for getting their accounts opened in the bank for providing them the benefits under the Indira Awas scheme. It is submitted by the learned counsel for the petitioner that there is nothing on record to suggest that the amount was paid to the petitioner and co accused Satyendra Kumar Bhagat having similar accusation, has been granted anticipatory bail vide Cr. Misc. No. 34924 of 2014.

No.26320 of 2015 (2) dt.17-07-2015 2/2 Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Sakra P.S. Case No. 164 of 2011 subject to the conditions as laid down under Section 438(2) Cr.P.C.
