JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 Heard learned counsel for the petitioners and the State. The petitioner are apprehending his arrest in a case instituted under Sections 341, 323, 323, 504/34 of the Indian Penal Code.
The prosecution story, in brief, is that the informant was sitting near her house. In the meantime the wife of Doman Yadav came before informant's house and the informant asked the wife of Doman Yadav (Minta Devi) as Minta Devi does not allow the informant to take away the water from hand pump. Minta Devi protested not to go from that very place and she began to abuse the informant, in the meantime the present petitioners and other came there and started to abuse and assault and firing was
Patna High Court Cr.Misc. No.27856 of 2015 (2) dt.23-07-2015 2/2 being started.
It has been submitted on behalf of the petitioners that there is land dispute between the parties. Further, it has been submitted that no one was injured in course of occurrence. The petitioners have got no criminal antecedent.
On behalf of the State, it has been submitted that the petitioners are named in the FIR..
Considering the aforesaid facts, let the above named petitioner, in the event of their arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned C.J.M.,Sheikhpura in connection with Sheikhpura (Kosumbha O.P.) P.S.Case no. 108/2015, subject to the conditions as laid down u/s 438(2) Cr.P.C.
