JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 04-07-2018 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Balliya P.S. Case No. 165 of 2017 for the offenses under Sections 448, 341, 323, 324, 307 IPC and Sections 3⁄4 Explosive Substances Act.

From the impugned order it appears that in the instant case after supervision the Supervising Authority has examined the case and was of the view that the petitioner has been falsely implicated in this case. However, in the instant case charge sheet has been submitted by the prosecution.

The petitioner is in custody since 14.9.2017 and there is observation in the supervision note in favour of the petitioner. Considering the totality of the fact situation, let the
