JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 14-10-2022 Heard learned counsel for the petitioner and the State. Petitioners apprehend arrest in a case registered for the offence punishable under Sections 30(a), 32, 41, 56(a) of Bihar Prohibition and Excise Act 2016 and Excise Amendment Act, 2018.

Prosecution case is that the petitioner apprehends his arrest in a case registered for the offences. 25 litres of country made liquor was recovered from the house of the co-accused. Learned counsel appearing for the petitioners submits that the petitioners have falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioners and they are no way connected

Patna High Court CR. MISC. No.41181 of 2022(3) dt.14-10-2022 2/2 with the aforesaid recovery. Petitioners have got no criminal antecedent.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let both the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge V- cum- Exclusive Special Excise Court no. 02, Lakhisarai subject to the conditions laid down under section 438 of the Code of Criminal Procedure.
