This application for anticipatory bail arises out of Patna Jn. Rail P.S. Case No. 579 of 2017 for the offence under Sections 370 and 374/34 of the Indian Penal Code, Section 14 of the Child Labour (Prohibition and Regulation) Act, 1986, Section 26 of the J.J. Act and Section 17 of the Bonded Labour System (Abolition) Act, 1976.

It is the case of the prosecution that from one compartment of a train, 14 minor children were recovered, who were travelling with co-accused Md. Must Hasan and were being taken to Maharashtra for being engaged as labourers, in violation of the provisions of the Acts as noted above. It appears that the said co-accused disclosed the name of this petitioner as the one involved in such illegal activities of trafficking of minors.

Patna High Court CR. MISC. No.42305 of 2019(2) dt.10-07-2019 2/2 Considering the seriousness of the offence alleged, I am not inclined to grant the petitioner privilege of anticipatory bail. This application is accordingly dismissed. The petitioner is directed to surrender before the Court below within a period of four weeks from today and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered by the learned Court below on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
