03-08-2023 Heard learned counsel for the parties.

2. The petitioner apprehends his arrest in a case registered for the offence under Sections 302, 201, 379 and 34 of the Indian Penal Code.

3. As per the prosecution case, the F.I.R. named accused persons including this petitioner are alleged to have committed the murder of son of informant and threw the deadbody near Tati river at lonely place.

4. Petitioner is not named in the F.I.R. Name of the petitioner transpired during course of investigation merely because he happens to be father of co-accused Abhishek Kumar, against whom, informant has raised suspicion of killing her son. It is further submitted that in Sessions Trial No. 175 of 2022 in the case of co-accused Abhishek Kumar, seven witnesses have been examined and none of them has whispered the name of petitioner. Petitioner has got clean antecedent.

5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.

6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Sheikhpura in connection with Sheikhpura (Kusumbha O.P.) P.S. Case No. 374 of 2020, corresponding to G.R. No. 1041 of 2020, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
