JUSTICE ARUN KUMAR ORAL ORDER 16-07-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 31.03.2018, seeks bail in Fatuha PS Case No.184 of 2018, Special Case No 25 of 2018 registered under Sections 20/22 of N.D.PS. Act. The allegation in brief is that 450 grams of ganja was recovered from the kiosk of the petitioner.
Learned Counsel for the petitioner submits that the recovery is false, the quantity is small and the petitioner has no criminal antecedent.
Having considered the said facts and circumstances, the petitioner, namely, Ram Janam Singh is directed to be released on bail after framing of the charge on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Sessions Judge/Special Judge, Patna in connection with Special Case No. 25 of 2018 arising out of Fatuha PS Case No. 184 of 2018.
