ANJANA MISHRA ORAL ORDER 12-10-2015 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioners are apprehending their arrest in connection with Vaishali P.S.Case No. 244 of 2013 registered under Sections 147, 148, 149, 341, 323, 324, 436 and 504 of the Indian Penal Code.

Learned counsel for the petitioners submits that the entire case against the petitioners is a sequel to the case filed by the petitioners against the informant of the present case. It is submitted that admittedly there was land dispute between the parties and as a result of the same there was some altercation. It is further submitted that the injuries purported to have been inflicted

Patna High Court Cr.Misc. No.27644 of 2015 (3) dt.12-10-2015 are simple in nature, which stand testified by the case diary. Considering the aforementioned facts and circumstances and that save and except one more case is pending against the petitioners there is no other history of prosecution, let the petitioners, above named, in the event of their arrest/surrender in the court below within period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each in connection with Vaishali P.S.Case No. 244 of 2013 to the satisfaction of the Chief Judicial Magistrate, Vaishali at Hajipur, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
