JUSTICE RAKESH KUMAR ORAL ORDER 20-12-2016 Heard Smt. Shama Sinha, learned counsel for the petitioner and learned Additional Public Prosecutor. The petitioner, who is in custody since 25.8.2016 in Jalley P.S. Case No. 176 of 2016 corresponding to G.O. Case No. 15 of 2016 registered for the offence under Section 22/ 23 of the Narcotic Drugs And Psychotropic Substances Act has prayed for grant of bail.

By way of referring to the statement made in paragraph no. 3 of the petition, it was submitted by learned counsel for the petitioner that petitioner is having clean antecedent , however he has falsely been implicated showing recovery of about 500 grams of Ganja and it has been argued that even the recovered Ganja is much lesser than the smaller quantity.

Patna High Court Cr.Misc. No.47538 of 2016 (2) dt.20-12-2016 2/2 Learned Additional Public Prosecutor has opposed the prayer for bail.

However, considering clean antecedent of the petitioner as well as recovered lesser quantity of Ganja , let the petitioner Rakesh Kumar @ Hari Dubey be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of learned Special Judge/ Sessions Judge, Darbhanga / concerned court in connection with G.O. Case No. 15 of 2016 arising out of Jalley P.S. Case No. 176 of 2016 .
