The petitioner seeks bail in Forbesganj P.S. Case No. 77 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

One Nitesh Kumar Mandal was apprehended and from his possession, 27 litres country made liquor was recovered. Nitesh Kumar Mandal disclosed the name of the petitioner that they were carrying the liquor. The petitioner was not apprehended from the spot. Petitioner is in jail since 19.02.2017 and he has remained in jail for more than 21⁄2 months.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 5,000/- (Five thousand) with two sureties of the like

Patna High Court Cr.Misc. No.21836 of 2017 (2) dt.12-05-2017 2/2 amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 77 of 2017.
