Informant Md. Sakur along with his nephew Jafar was returning after sipping a cup of tea and as soon as reach near the house of the Rasid the accused persons so named therein including the petitioner, variously armed, encircled both of them and began to assault. His nephew Jafar fell down. Informant succeeded in his rescue and came to his house who was being chased by the members of the mob, who after arrival ransack his house. During course thereof, Masi, Masoon, Hasib, Shamim and others came who were also assaulted. Informant's Bhabhi was assaulted by Fakhroo with sickle. Yasin was assaulted with iron rod by Saud with Datria. Altogether ten persons were assaulted. From the order impugned, which has been passed after perusal of the case diary coupled with the fardbeyan, it is evident that petitioner does not carry specific allegation. Furthermore, he happens to be under custody since 07.08.2016.

Patna High Court Cr.Misc. No.47544 of 2016 (2) dt.08-11-2016 Accordingly, petitioner Biku is directed to be released on bail on furnishing bail bonds of Rs.10,000/-(ten thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Chief Judicial Magistrate, Araria in connection with Jokihat P.S.
