JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Jagdishpur P.S. Case No. 551 of 2017 for the offence under Sections 363 and 355 of the Indian Penal Code. Later on Sections 302 and 201 of the Indian Penal Code have been added. Learned counsel for the petitioner submits that the case was registered against unknown. He further submits except the confessional statement, there is no material to implicate this petitioner. Learned counsel submits that the petitioner has got no criminal antecedent. The petitioner is languishing in jail since 06.12.2017.

Considering the fact that the petitioner has not criminal antecedent and there is no direct evident about the participation of this petitioner in the crime, the petitioner, named

Patna High Court Cr.Misc. No.27744 of 2018 (3) dt.03-07-2018 2/2 above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bhagalpur in connection with Jagdishpur P.S. Case No. 551 of 2017.
