Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Sakra P.S. Case No. 681 of 2020 lodged under Sections 306/34 of the I.P.C.

As per the prosecution case, it has been alleged that the nephew of the informant has been killed by 5 named accused persons. Subsequently, it has been alleged that the deadbody of informant's nephew was recovered near railway line, situated near railway gumti.

Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. He submits

Patna High Court CR. MISC. No.41950 of 2022(3) dt.05-12-2022 2/2 that the present case has not filed under Section 302 of the I.P.C., rather it has been filed under Section 306/34 of the I.P.C. Learned counsel for the petitioner submits that it has also come in the case diary that the death of the victim has been caused due to heavy, hard and blunt object and it has also come that due to accident by train victim died. He further submits that petitioner is in custody since 06.03.2022 having clean antecedent. Charge sheet has already been filed in this case. Learned counsel for the State opposes the prayer for bail.

In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. 12th Muzaffarpur in connection with Sakra P.S. Case No. 681 of 2020, subject to the conditions as laid down under Section 437(3) of Cr.P.C. With this observation, the bail application stands allowed.
