The petitioner seeks bail in Jagdishpur (Gauradih) P.S. Case No. 376/2018, instituted for offence under Section(s) 302/37 of the Indian Penal Code read with Section 27 of Arms Act.

Learned counsel for the petitioner has submitted that petitioner is not named in the written report. The informant, who is wife of the deceased, has earlier filed written report against unknown. It is alleged that after about two months of the occurrence, informant has filed petition before the learned Chief Judicial Magistrate on 29.09.2018 naming four accused persons including petitioner. Informant has raised suspicion against this petitioner and others.

Patna High Court CR. MISC. No.41017 of 2019(2) dt.09-07-2019 2/2 The other co-accused persons have already been granted bail by this Court vide order dated 07.05.2019 passed in Cr. Misc. No. 29141/2019 and Cr. Misc. No. 29798/2019. Petitioner is in custody since 12.03.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhagalpur, in connection with Jagdishpur (Gauradih) P.S. Case No. 376/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner. (Sanjay Priya, J) rakhi/- U T
