JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-09-2019 Petitioner seeks bail in anticipation of his arrest in connection with Tajpur P.S. Case No. 337 of 2017 registered for the offences punishable under Sections 25(1-B)(a), 26 and 35 of the Arms Act.

Prosecution case is that police on information that some accused persons assembled at the house of one Harendra Prasad Singh raided the place and arrested two accused persons and from them one country-made rifle loaded with cartridges was recovered and they have disclosed the name of the petitioner.

Submission of learned counsel for the petitioner is that though there is allegation against accused persons that they have assembled for kidnapping of daughter of Harendra Prasad Singh but the same has not been proved and considering the

Patna High Court CR. MISC. No.37168 of 2019(3) dt.19-09-2019 2/2 same co-accused has been granted anticipatory bail by a coordinate Bench of this Court by order dated 22.8.2019 passed in Cr.Misc.No. 36887 of 2019.

In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Samastipur, in connection with Tajpur P.S. Case No. 337 of 2017, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
