JUSTICE RAKESH KUMAR ORAL ORDER 22-10-2016 Heard Sri Krishna Prasad Singh, learned senior counsel who was assisted by Sri Mithilesh Kumar Singh, learned counsel for the petitioner and Sri Madan Kumar, learned Additional Public Prosecutor.

The sole petitioner who is in custody since 27.8.2016 having clean antecedent which has been stated in paragraph no. 3 of the petition has prayed for grant of bail in Mohania P.S. Case No. 412 of 2016 registered for the offence under Section 399 and 402 of the Indian Penal Code.

It was submitted by learned senior counsel for the petitioner that petitioner along with other four persons were arrested on suspicion while they were sitting on a vehicle. He submits that the said vehicle was subsequently released in

Patna High Court Cr.Misc. No.45739 of 2016 (2) dt.22-10-2016 2/2 favour of owner of the vehicle. He also submits that other three accused have been granted bail.

Keeping in view the nature of accusation, clean antecedent of the petitioner and period of custody, let the petitioner Happy Singh be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua / concerned court in connection with Mohania P.S. Case No. 412 of 2016.
