ANJANA MISHRA ORAL ORDER 20-11-2019 Shri Arvind Kumar, Advocate, states that he will be filing Vakalatnama in the Registry as Mr. Sanjay Kumar Griyaghey, has given no objection and he will be appearing in future on behalf of the petitioner.

Learned counsel for the opposite party No. 2 as also opposite party No. 2 are present in person.

It appears that there was conflict between the parties and the case has been adjourned to 20th of November, 2019, on which date both the parties were directed to appear in person. Today, there is no appearance on behalf of the petitioner and he is conspicuous by his absence. Learned counsel for the opposite party No. 2 submits that the petitioner is prevaricating and, therefore, the order dated

Patna High Court CR. MISC. No.37557 of 2019(5) dt.20-11-2019 2/2 24.06.2019 granting provisional anticipatory bail in favour of the petitioner be recalled.

However, opposite party No. 2 submits that though the petitioner has been seen in the premises of the Patna High Court, he is not present in compliance of the earlier direction of the Court. This act clearly amounts to deliberate violation which is taken serious note by this Court.

Accordingly, the order dated 24.06.2019, granting provisional anticipatory bail to the petitioner stands withdrawn and the prayer for grant of anticipatory bail is hereby rejected. Let the court below take appropriate steps for cancellation of his bail bonds for taking him into custody. (Anjana Mishra, J) Saif/- U T
