The petitioner seeks bail in a case registered under Sections 387, 506 of the Indian Penal Code.

Prosecution case, in short, is that on 1.3.2019 at about 4.40 P.M. the informant received a call on his mobile, which was coming from mobile No.7070522942. The caller demanded Rs.10 lacs as rangdari.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 6.3.2019 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated

Patna High Court CR. MISC. No.38275 of 2019(2) dt.27-06-2019 2/2 in the present case. The mobile in question does not belong to the petitioner. He has been made accused due to mistake of fact. On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Motihari Town P.S. case No.145 of 2019.
