JUSTICE SATYAVRAT VERMA ORAL ORDER 22-12-2022 Heard learned senior counsel for the petitioner assisted by Ms. Shatabdi Sinha, learned senior counsel for the informant assisted by Mr. Anil Kumar Sinha and learned A.P.P. for the State.

The learned counsel for the parties, at the outset, submits that without going into the merits of the case the parties have compromised.

The learned senior counsel for the petitioner submits that he has instruction to make submission that he will pay an amount of Rs. 16 lakh to the informant within a period of six months from today.

The learned counsel for the informant submits that he also has instruction to accept the offer given by the learned

Patna High Court CR. MISC. No.42271 of 2022(3) dt.22-12-2022 2/3 counsel for the petitioner. The learned senior counsel for the informant submits that in the event if Rs. 16 lakh is paid within a period of six months from today, then the informant will withdraw the present case.

Considering the submissions made by the learned senior counsel for the parties, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on provisional bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Gandhi Maidan P.S. Case No. 271 of 2019 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

Further, in the event, if the informant files an application before the learned trial court bringing to its notice that the petitioner despite agreeing to pay an amount of Rs. 16 lakh within a period of six months from today has not paid the said amount or any amount still remains to the paid, the learned trial court after giving an opportunity of hearing to the petitioner shall pass orders in accordance with law and shall also have liberty to cancel the bail bonds of the petitioner.
